This Privacy Policy describes how iFIT Inc. and our subsidiaries and affiliated companies (collectively, “iFIT,” “we,” “our,” or “us”) collect, use, disclose, and otherwise process information about you. This Privacy Policy applies to the information we collect when you use our websites, mobile apps, connected workout equipment (such as NordicTrack and ProForm), and other products and services that link to this Privacy Policy (collectively, “iFIT Services”), or when you otherwise interact with us, such as if you communicate our sales team or customer service specialists, or interact with us at an event or on social media. We may provide different or additional notices of our privacy practices for certain offerings, in which case those notices will supplement or replace the disclosures in this Privacy Policy.

      1. COLLECTION OF DATA

      The information we collect about you depends on how you interact with us and how you use the iFIT Services. In this section, we describe the categories of information we collect and the sources of this information.

      Data You Provide to Us

      We collect personal data that you provide directly to us. For example, we collect information directly from you when you create an account, add information to your profile, fill out a form, make a purchase or subscribe to certain iFIT Services, interact with our AI coach, sign up for our marketing communications, participate in a survey, contest, sweepstakes, or promotion we offer, provide us feedback, request customer support, or otherwise communicate with us. The types of data we collect include your first and last name, username and password, birth month and year, email address, postal address, and phone number. We also collect certain fitness data that you choose to provide in connection with your iFIT account, such as height, current weight and goal weight, workout and fitness goals, fitness level, and other interests and preferences that you choose to provide. If you make a purchase from us, we work with a third-party payment processor to collect and process your payment information.

      Data We Collect Automatically

      We automatically collect certain data about your interactions with us and the iFIT Services, including:

      • Activity Data: We collect information about your activity on the iFIT Services, such as workouts and activities completed, calories burned, challenges you participate in, and content you engage with. If you connect a heart rate monitor to the iFIT Services, we will also receive information about your heart rate during workouts.
      • Transactional Data: When you make, exchange, or return a purchase, we collect information about the transaction, such as product details, purchase price, and the date and location of the transaction.
      • Device and Usage Data: We collect data about how you access the iFIT Services, including data about the device and network you use, such as your hardware or machine model, operating system version, mobile network, IP address, unique device identifiers, browser type, time zone, and app version. We also collect information about your activity on the iFIT Services, such as access times, pages viewed, and links clicked.
      • Audio, Video, and Chat Data: If you contact customer service through our chat feature or by phone, or if you participate in a video consult with our sales team, we may monitor and retain those interactions, including for training purposes.
      • Data Collected by Cookies and Similar Tracking Technologies: We use tracking technologies, such as cookies, pixels, SDKs, and APIs to collect information about your interactions with the iFIT Services and our communications with you. These technologies help us improve the iFIT Services, personalize your experience, count visits, understand if you open or acted upon an email we sent, and analyze trends.       Data We Collect from Other Sources

      We receive additional fitness data if you choose to connect your iFIT experience with one of the integrations we support, such as through Strava, Apple Health, or Google Fit. The types of fitness data iFIT may receive from these sources include heart rate, physical patterns and rhythms from workouts, estimated calories burned, and other information and statistics related to your workouts. We may also receive precise geolocation information associated with your workouts if you consent to enabling such feature through an integration we support. See the Your Choices section for information about how to turn off this data collection at any time.

      If you engage with iFIT as part of a corporate partnership we offer (such as if your employer sponsors your iFIT subscription), we may receive certain information from the partner, such as your contact information and information about your role in the partner’s organization.

      We may also obtain data from other sources, such as demographic, interest, and contact data from data brokers and aggregators and publicly available sources. Partners that provide technical, payment, delivery, and other services may also provide information to us in connection with their services, such as delivery or repair confirmations.

      Data We Derive

      We may derive data and draw inferences about you based on the other data we collect. For example, we will recommend certain workouts and activities we think will interest you or help you meet your fitness goals based on your preferences and workout history.

      2. USE OF DATA

      We use the categories of data we collect to provide the iFIT Services to you, including to customize your workout recommendations and help you meet your fitness goals. We also use the data we collect to:

      • Process your transactions and deliver your orders;
      • Deliver recommendations and communicate with you through our AI Coach if you choose to use it;
      • Maintain and improve the iFIT Services and develop new products and services[, which may include developing and training our own AI models];
      • Monitor and analyze trends, usage, and activities in connection with our products and services;
      • Send you technical notices, security alerts, support messages and other transactional or relationship messages and respond to your requests and inquiries;
      • Communicate with you about products, services, and events offered by iFIT and others and provide news and information, including other fitness offerings, that we think will interest you (see the Your Choices section below for information about how to opt out of these communications at any time);
      • Target advertisements to you on third-party platforms and websites (for more information and to opt out, see the Your Choices section below);
      • Facilitate contests, sweepstakes, and promotions and process and deliver entries and rewards;
      • Detect, investigate, and help prevent security incidents and other malicious, deceptive, fraudulent, or illegal activity and help protect the rights and property of iFIT and others; and
      • Comply with our legal and financial obligations.

      3. DISCLOSURE OF PERSONAL DATA

      We may disclose the categories of personal data we collect as follows or as otherwise described in this Privacy Policy:

      • Vendors and Service Providers: We make personal data available to our vendors, service providers, contractors and consultants that perform services on our behalf, such as companies that assist us with web hosting, system administration, shipping and delivery, payment processing, financing, fraud prevention, customer service, analytics, and marketing.

      • Integration Partners: We may disclose personal data to third parties with which you have a direct relationship to provide a product or service you request. For example, we may disclose information to integration partners like Strava, Apple Health, or Google Fit if you decide to connect your iFIT account with such third-party accounts.
      • To Other iFIT Users: If you post content, such as workout or product reviews to the iFIT Services, other users of the iFIT Services will be able to see this information.
      • In Connection with Corporate Partnerships: If you engage with iFIT in connection with a corporate partnership (such as if your employer sponsors your iFIT subscription) we may provide certain data to such partner. For example, if you choose to participate in a workout challenge offered by your employer, we may share workout details in connection with the challenge.
      • Law Enforcement Authorities and Individuals Involved in Legal Proceedings: We disclose personal data in response to a request for information if we believe that disclosure is in accordance with, or required by, any applicable law, regulation or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements.
      • To Protect the Rights of iFIT and Others: We disclose personal data where necessary if we believe that your actions are inconsistent with our user agreements or policies or if we believe that you have violated the law (for example to our legal advisors or to the appropriate authorities), or if we believe it is necessary to protect the rights, property, and safety of iFIT, our users, the public, or others.
      • Professional Advisors: We disclose personal information to our legal, financial, insurance and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.
      • Corporate Transactions: We disclose personal data in connection with, or during negotiations of certain corporate transactions, including the merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
      • Corporate Affiliates: Personal data is disclosed between and among iFIT and our parents, affiliates, subsidiaries, and other companies under common control and ownership.
      • Consent and at Your Direction: We make personal data available to third parties when we have your consent or you intentionally direct us to do so.

      4. TARGETED ADVERTISING AND ANALYTICS

      We engage others to provide analytics, serve advertisements, and perform related services across the web and in mobile apps. These entities may use cookies, web beacons, SDKs, device identifiers, and other technologies to collect information about your use of the iFIT Services and other websites and mobile apps, including your IP address, web browser, mobile network information, pages viewed, time spent on pages or in mobile apps, links clicked, and conversion information. This information is used to deliver advertisements targeted to your interests on other companies’ sites or mobile apps, understand the effectiveness of these advertisements, analyze and track data, and better understand your online activity. You can opt out of cookie-based ad targeting on websites that link to this Privacy Policy by following the prompts at the link titled “Your Privacy Choices ” in the footer of the iFIT website you are visiting. If you’re based outside of the United States, you can make choices about cookies using the Cookie Settings link, in the footer of the iFIT website you are visiting. You will need to exercise this choice on each of our websites that you visit, and renew this choice if you visit one of our websites from a new device or browser, or if you clear your browser’s cookies.

      In addition to cookie-based ad targeting, we may disclose identifiers, such as your email address, to some of our advertising partners. These advertising partners translate that information into a unique identifier that can then be used to show ads that are more relevant to you across the web and in mobile apps. If you reside in certain U.S. states, you may opt out of these disclosures by filling out our webform. If you reside in the European Economic Area, the United Kingdom, or Switzerland, please withdraw your consent using this webform.

      5. DATA RETENTION

      We retain your personal data for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements.

      To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data, whether we can achieve those purposes through other means, and the applicable legal requirements. For example, we retain your email address and information about your marketing preferences to ensure that we can honor those preferences.

      In some circumstances, we may aggregate or de-identify your personal data (so that it can no longer be reasonably associated with you), including for research and product improvement purposes. iFIT processes, maintains, and uses this information only in a de-identified fashion and will not attempt to re-identify such information, except as permitted by law.

      6. OUR POLICY REGARDING MINORS

      iFIT Services are intended for individuals who are at least 16 years of age, and parental permission is required for individuals under 18. Please see our Terms of Service for details. We do not knowingly collect the personal information of any individuals who are under 16. If you believe that your child has submitted personal data to us, please contact us.

      7. YOUR CHOICES

      Account Information

      You can access, modify, and delete certain information stored within your iFIT account by logging into your account at any time.

      Communications Preferences

      You may opt out of or withdraw your consent for receiving text messages or promotional emails from us by following the instructions in those communications or by logging into your iFIT account and adjusting your marketing preferences.

      If you opt out of promotional communications, you will still receive transactional emails from us, such as those about your account or orders.

      Cookies

      You can adjust certain cookie settings on iFIT websites that link to this Privacy Policy by clicking the “Your Privacy Choices ” or, if outside of the United States, the “Manage Cookies” link in the footer of the website. In addition, you can usually set your browser to refuse all or some browser cookies.

      Push Notifications

      With your permission, we may send push notifications to your mobile device. You can deactivate these messages at any time by changing the notification settings on your mobile device.

      Third Party Integrations

      If you choose to use integrations we offer in connection with the iFIT Services, such as through partners like Strava, Apple Health, or Google Fit, you may turn off or change the permissions (including location data permissions) for these integrations at any time by following the instructions in the settings menu of your iFIT account.

      8. ADDITIONAL INFORMATION FOR RESIDENTS OF CERTAIN U.S. STATES 

      California, Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah, and Virginia have enacted consumer privacy laws that grant their residents certain rights and require additional disclosures (“State Privacy Laws”). If you are a resident of one of these states, this section applies to you.

      Our Privacy Policy explains how we collect, use, disclose information about you as well as our targeted advertising and analytics practices. As required by some State Privacy Laws, below we use two different tables to explain this same information.

      Your Privacy Rights

      Opt Out of Sale, Sharing, and Targeted Advertising

      You have the right to opt-out of activities we engage in that constitute “sales,” “sharing,” or “targeted advertising” under State Privacy Laws, which you may do by following the instructions presented when you click the footer link titled “Your Privacy Choices ” in the iFIT websites that link to this Privacy Policy or visiting our websites with the Global Privacy Control ("GPC") or another legally recognized opt-out signal enabled. Please note that, depending on which legally recognized opt-out preference signal you use, our processing of the signal may be limited to the specific browser or device that you are using.

      In addition to cookie-based ad targeting, we may disclose your identifiers, such as your email address and phone number, to our advertising partners. These advertising partners translate that information into a unique identifier that can then be used to show ads that are more relevant to you across the web and in mobile apps. You may opt out of having your identifiers disclosed for these purposes by following the instructions here.

      Access, Correct, and Delete Personal Data

      You have the right to (1) request to know more about and access your personal data, including in a portable format, (2) request deletion of your personal data, and (3) request correction of inaccurate personal data. To request access, correction, or deletion of your personal data, please fill out this form or call our toll-free number at 1.866.608.1798. We will verify your request by asking you to provide certain information, such as your name and email address, and in some cases, information about your activity on the iFIT Services. You can also access, modify, and delete certain information stored within your online account by logging into your account at any time.

      Appeals

      If we deny your request, you may appeal our decision by contacting us at privacy@ifit.com. If you have concerns about the results of an appeal, you may contact the attorney general in the state where you reside.

      Nondiscrimination

      We will not discriminate against you for exercising your privacy rights.

      Authorized Agents

      If you reside in certain states, you may designate an authorized agent to submit a privacy rights request on your behalf. We may ask authorized agents to submit proof of their authority to make a request, such as a valid power of attorney or proof that they have signed permission from the consumer who is the subject of the request. In some cases, we may contact the individual who is the subject of the request to verify their own identity or confirm the authorized agent has permission to submit the request.       Notice of Financial Incentives

      From time-to-time, we offer coupons, discounts, and other benefits to consumers who have chosen to participate, such as consumers who have opted-in to the receipt of marketing communications from us.

      These offerings may constitute “financial incentives” or “bona fide loyalty programs” under certain state privacy laws (for simplicity, we refer to these collectively as “financial incentives”). If you participate in a financial incentive, we collect personal data from you. The categories of personal data we may collect include identifiers (such as your name, email address, postal address, phone number), commercial information (such as products purchased), and interest information (such as workout preferences). We may disclose this information to our service providers, contractors, and consultants who perform services on our behalf.

      You may opt into a financial incentive by following the sign-up instructions we provide. You may revoke your consent and withdraw from a financial incentive program at any time by following the instructions in relevant communications or by emailing us at privacy@ifit.com. If you request that we delete any of your personal data that is essential to providing you with the financial incentive, we will not be able to provide you with the benefits of that program (e.g., if you ask us to delete your email address, we will no longer be able to provide you with early access to sales or other benefits via email). In some cases, we may provide additional terms and conditions, which we will provide to you when you sign up. The value of your personal data is reasonably related to the value of the offer or discount presented to you.

Whenever we make restricted international transfers of personal data, we take steps to ensure that your personal data receives an adequate level of protection (by putting in place appropriate safeguards, such as contractual clauses), or to ensure that we are able to rely on an appropriate derogation under data protection laws. You have a right to request access to any safeguard which we use to transfer your personal information outside of the EEA, the United Kingdom, or Switzerland (although we may need to redact data transfer agreements for reasons of commercial confidentiality).

      Some of our data processors may transfer personal data outside of the EEA, the United Kingdom, or Switzerland and, as stated above, we will always ensure there are appropriate safeguards in place so that such transfers are lawful.

      You have the right to (1) request to access your personal data, including in a portable format, (2) request deletion or erasure of your personal data, and (3) request correction of inaccurate personal data.
