OFFICIAL RULES

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.Sponsor.  These Official Rules (“Rules”) govern the operation of the IntelliSurvey Sweepstakes (“Sweepstakes”). IntelliSurvey, Incorporated, 27261 Las Ramblas, Suite 200, Mission Viejo, CA 92691 is the Sweepstakes sponsor (“Sponsor”). Sponsor is not an affiliate of ICON Health & Fitness, Inc. (“ICON”), and Sponsor bears sole responsibility for administering the Sweepstakes. Your entry in the Sweepstakes constitutes your full and unconditional agreement to these Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes.

Definitions.  In these Rules, “IntelliSurvey”, “we”, “our”, and “us” refer to Sponsor, and “participant”, “entrant”, “you”, “your”, and “yourself” refers to a Sweepstakes participant.

Entry Period.  The Sweepstakes begins on March 15, 2021 at 12:00 a.m. Eastern Time and ends on March 28, 2021 at 11:59 p.m. Eastern Time (“Entry Period”). All eligible entries must be received within the Entry Period. Sponsor is the official timekeeper for determining compliance with the Entry Period.

Eligibility.  The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are 18 years or older at the time of participation. Void where prohibited by law. Employees of Sponsor or ICON or their respective affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production, execution, or distribution of the Sweepstakes and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members (people who share the same residence at least three (3) months out of the year) of each such employee are not eligible. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Winning a prize is contingent upon fulfilling all requirements set forth herein.

How to Enter.  NO PURCHASE NECESSARY TO ENTER OR WIN. Purchase or payment of any kind will not increase your chances of winning. Enter the Sweepstakes by logging on to https://m1.intellisurvey.com/run/k21031735c to register. You will be asked to register your opinions and will be automatically entered in the Sweepstakes after doing so. Limit one (1) entry per person. Any attempt by you to obtain more than the stated number of entries by using multiple/different accounts, identities, registrations, logins, or any other methods will void your entries and you may be disqualified. Use of any automated system to participate is prohibited. In the event of a dispute regarding the identity of the person submitting the entry, entry will be deemed submitted by the person in whose name the telephone or Internet account is registered, or whose name and address are listed on the entry, provided that person meets all eligibility criteria. Sponsor is not responsible for: late, incomplete, delayed, undelivered, or misdirected entries. Proof of entry does not constitute proof of receipt. Sponsor shall not be liable for any problems that occur during the entry process and shall not have any obligation to advise an entrant of an incomplete or undeliverable entry.

Winner Selection.  After the Entry Period, five (5) winners will be selected randomly from all eligible entries received within the Entry Period. The drawing will be conducted by Sponsor or its designee, the judges of the Sweepstakes, whose decisions shall be final and binding on all matters relating to the Sweepstakes. No one will know who the winners are until after the random drawing.

Prizes.  Each of the five (5) winners will receive an Amazon gift code for $100 (Average Retail Value of each prize: $100). The prizes will be awarded, provided they are properly claimed in accordance with these Rules. Prizes are awarded “AS IS” with no warranty of any kind, either express or implied, including but not limited to, the implied warranties or merchantability, fitness for a particular purpose, or non-infringement. No prize transfers, cash redemption, or substitutions permitted except in the event of unavailability of prize, in which case Sponsor may, in its own discretion, substitute a prize of equal or greater value. All federal, state, and local taxes on prize, if any, are the sole responsibility of the winner.

Odds of Winning.  Odds of winning depend upon the total number of eligible entries received. All entries have the same chance of winning.

Winner Notification and Verification.  Winners will be notified by mail and will be required to sign and return an affidavit of eligibility and liability/publicity release within fourteen (14) days of notification. If Sponsor is unable to contact a winner despite Sponsor’s reasonable efforts to do so, an alternate winner will be selected. Failure to return the signed affidavit of eligibility and liability/publicity release within fourteen (14) days of notification, or return of any prize notification or prize as undeliverable, may result in forfeiture of prize and selection of alternate winner, in Sponsor’s sole discretion.

Disclaimer, Release, and Limitations of Liability.  By entering, each participant agrees to: (a) comply with and be bound by these Rules and the decisions of Sponsor and/or its designee; (b) release and hold harmless Sponsor, ICON, and each of their respective parents, subsidiary, and affiliated companies, the prize suppliers, and any other organizations responsible for sponsoring, fulfilling, administering, advertising, or promoting the Sweepstakes, and all of their respective past and present officers, directors, employees, agents, and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to: negligence and damages of any kind to persons and property, including but not limited to: invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye, or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Sweepstakes, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation, or use of entry; and (c) indemnify, defend, and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorney’s fees) arising out of or relating to an entrant’s participation in the Sweepstakes and/or entrant’s acceptance, use, or misuse of the prize.

The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Sweepstakes; (b) technical failures of any kind, including, but not limited to: malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; (d) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from an entrant’s participation in the Sweepstakes or the receipt or use or misuse of any prize.

Publicity.  Submission of entry constitutes permission for Sponsor to use a winner’s Sweepstakes entry, name, city and state of residence, picture, likeness and biographical information, participation in the Sweepstakes and any material based thereon or derived therefrom, or to refrain from so doing, for all advertising, trade, or promotional uses, without further compensation, worldwide and in perpetuity, in all forms of media, now known or hereafter devised, except where prohibited by law.

Personal Information.  Sponsor will securely store and consider confidential all personal information submitted by entrants and will not sell or otherwise disclose it to any outside company other than ICON or its authorized affiliates and agents, except as otherwise provided by the foregoing paragraph governing publicity of certain information pertaining to a Sweepstakes winner.  Personal information collected from entrants in connection with the Sweepstakes will be subject to ICON’s Privacy Policy, which is available at https://www.ifit.com/privacypolicy.

Dispute Resolution.  Any controversy or claim arising out of or relating to this Sweepstakes shall be settled by binding individual arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered by the United States District Court for the District of Utah or the appropriate court of the State of Utah located in Cache County, Utah. Arbitration under this provision shall not be conducted as a class-action and you may not serve as a representative, a private attorney general, or in any other representative capacity for others in such arbitration. The governing law in any such arbitration shall be the law of the State of Utah.
